LATEST NEWS: BIG WIN FOR NIGERIA

Nigeria has emerged victorious in an international arbitration dispute with European Dynamics UK Ltd, saving the country $6.2m (approximately ₦9.3bn) in claimed payments and damages. The dispute centered on a national e-Procurement project managed by the Bureau of Public Procurement (BPP) and financed by the World Bank.

The tribunal, led by Sole Arbitrator Mrs. ‘Funmi Roberts, ruled in favor of Nigeria, dismissing European Dynamics’ claims in their entirety. The contractor had claimed $2.4m for alleged milestone completions, $3m in general damages, and $800,000 in settlement claims.

The BPP had argued that the contractor failed to deliver a functional system, citing significant deficiencies identified during User Acceptance Testing (UAT). The tribunal agreed, ruling that the contractor, as the technical expert, was responsible for ensuring the system met contractual requirements.

Attorney General Lateef Fagbemi hailed the victory, stating it’s a clear message that “Nigeria has resonated” and it’s “no longer business as usual”. BPP Director-General Dr. Adebowale Adedokun praised the Nigerian legal team, led by Johnson & Wilner LLP, for their expertise.

This win marks a significant milestone for Nigeria, demonstrating its commitment to protecting public resources and promoting transparency in government contracting.
